Agent Melon

The short version

This end-user licence agreement covers the Agent Melon app itself. It meets the app stores’ minimum licence terms and sits alongside the Terms of Service, which govern the game service, virtual items and purchases.

Acknowledgement

This licence is concluded between you and Lunana Global Inc. only, not with Apple Inc. or Google LLC. Lunana Global Inc., not the store operator, is solely responsible for the app and its content. The store operator has no obligation to provide maintenance or support for the app.

Scope of licence

You receive a limited, non-transferable, revocable licence to use the app on devices you own or control, as permitted by the usage rules of the store you obtained it from, including Family Sharing or similar household rules where the store offers them. You may not distribute the app, make it available over a network where it could be used by several devices at once, or decompile, reverse-engineer or modify it, except where the law permits this despite this restriction.

Updates

We may release updates that fix, change or remove features, and some updates may be required to keep using the app. This licence applies to every update we provide unless an update comes with its own licence.

Maintenance and support

Lunana Global Inc. provides support for the app at hello@agentmelon.co. The store operator has no obligation whatsoever to provide support.

Warranty

Quebec consumers: this section does not apply to you to the extent it is inconsistent with the Consumer Protection Act (Quebec).

The app is licensed “as is”, without warranty of any kind, to the maximum extent permitted by law. If the app fails to conform to an applicable warranty, you may notify the store operator, which may refund the purchase price of the app (if any). To the maximum extent permitted by law, the store operator has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are the responsibility of Lunana Global Inc. as set out in the Terms of Service.

Product claims

Lunana Global Inc., not the store operator, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection, privacy or similar laws.

Intellectual-property claims

If a third party claims that the app or your possession and use of it infringes that party’s intellectual-property rights, Lunana Global Inc., not the store operator, is solely responsible for the investigation, defence, settlement and discharge of the claim.

Legal compliance

You represent that you are not located in a country subject to a Canadian, United States or other applicable government embargo, or designated as a “terrorist supporting” country, and that you are not on any government list of prohibited or restricted parties.

Third-party terms

You must comply with applicable third-party terms when using the app, such as your mobile carrier’s data agreement and the terms of the store you obtained the app from.

Third-party beneficiary

Apple Inc. and its subsidiaries, and Google LLC, are third-party beneficiaries of this licence for copies of the app obtained through their respective stores. Once you accept this licence, each has the right (and is deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

Virtual items and purchases

Virtual currencies and items in the app, such as extra lives and equipment, are licensed, not sold, have no value outside the game, and are governed by the Terms of Service. In-app purchases are processed by the store operator, and refunds follow its policies except where the law provides otherwise.

Content and health

The app contains stylized cartoon violence in a fictional setting, and may contain flashing lights or patterns. The content and photosensitivity notices in the Terms of Service apply.

Third-party software

The app is built with the Unity engine and uses the Lilita One typeface, licensed under the SIL Open Font License 1.1. Notices required by other third-party licences are provided with the app or on request from hello@agentmelon.co.

Limitation of liability

The limitations and exclusions of liability in the Terms of Service apply equally to this licence, subject to the same consumer-law exceptions.

Privacy

How the app handles data is described in the Privacy Policy.

Term and termination

This licence is effective until terminated. It ends automatically if you seriously breach it or the Terms of Service, and you may end it at any time by deleting the app. When it ends you must stop using the app and delete all copies.

Governing law

This licence is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, and the courts of Vancouver, British Columbia have jurisdiction over disputes about it, subject to any mandatory consumer-law rights where you live, as described in the Terms of Service.
